Welcome to Ace Lawn Masters!
We are excited to provide you with high-quality lawn care maintenance services. Please read the following terms and conditions carefully, as they outline your responsibilities and obligations as our valued customer, and the standard by which business will be conducted between us. By using our services, you acknowledge to understanding, and agree to abide by these terms and conditions.
Services and Pricing
We offer a range of lawn care maintenance services, including mowing, edging, trimming, aeration, overseeding, mulch application, leaf cleanup, and debris/yard waste removal. Our prices are competitive and subject to change without notice. We reserve the right to refuse service to anyone for any reason.
Scheduling and Inclement Weather
We will do our best to provide services as scheduled. However, we cannot guarantee a specific time due to the unpredictable nature of lawn care maintenance services, including such a, influential factor as inclement weather. In the event of inclement weather, we reserve the right to reschedule your service to a later date to prevent damaging your lawn and for the safety of our team members. You will be notified of any changes to your scheduled service.
Property Damage and Liability
We take great care when servicing your lawn and property, but accidents can happen. We are not responsible for any damage caused to your property by natural occurrences or previous conditions. However, in the event that we cause damage to your property, we will record the accident and immediately notify you. If you believe we missed damages caused by us and missed during our final inspection, please inform us within 24 hours so that we could take the appropriate steps to address the issue. Please remove any lawn furniture, toys, or other items from the lawn before service. If you have solar lights or other items that cannot be moved, please let us know in advance. We are not responsible for any damage to property, including but not limited to sprinkler systems, irrigation systems, or any objects hidden beneath the grass. We do NOT move furniture, trampolines, small pools, garden hoses or any other tangible items that are naturally foreign to a lawn.
Limitation of Liability
The Service Provider will not be held responsible for any damages to the property or injury to persons not caused by Service Provider's negligence. In no event shall Ace Lawn Masters LLC or its owners, employees, or affiliates be liable for any damages or losses, including but not limited to personal injury, property damage, or loss of profits, arising from the use of our services.
Grievances
If you have any grievances regarding our services, please contact us in writing within 24 hours of the service. We will make a valid effort to address your concerns and find a resolution.
Pet Waste
We love our furry extended family. However, their waste left on the lawn prior to the scheduled service can cause health issues for the lawn, our staff, and potentially track diseases to other customers’ lawns. So, we kindly ask that you remove any pet waste from your lawn before we arrive for service. If pet waste is present during our service, we may need to skip the affected area. If our equipment becomes contaminated with your pet's waste, a "Pet Waste Fee" of $35.00 will be added to your invoice. If the pet waste is severe enough we reserve the right to reschedule services to a later date that suits our schedule. Additionally, if our team members arrived at your property, determine there's too much pet waste to proceed, you will be charged an "Inconvenience Fee" of $35.00. Both these fees are stackable as they represent separate matters. It takes us time to stop our scheduled route for the day to clean off our equipment. Trash Removal
We are not responsible for removing any trash or debris from your lawn. We reserve the right to charge an additional fee for any trash or debris left on the lawn. We always help our customers if there are only a handful of small and lightweight items of trash on the lawn. We are referring to lawns littered with trash or with more than a handful laying on designated service areas. If this is the case, we reserve the right to reschedule service until the trash is removed by the homeowner/tenant. Trash can damage equipment and poses a safety risk. If our team members have arrived at the service address, and must reschedule due to encountering this safety risk, an "Inconvenience Fee" of $35.00 will be added to your invoice.
Payment and Rescheduling
We accept payment via immediately upon completion of services, via credit card or debit card ONLY. Our Late Payment Fee of $35.00 may be charged for balances seven (7) days overdue from the date services are rendered. We DO NOT accept cash, check, money order, Google Pay, Apple Pay, Venmo, PayPal, Square, cryptocurrency, or any other forms of payment except via our Customer Relationship Management (CRM) software, currently provided by Jobber. If you need to reschedule your service, please provide at least 24 hours' notice. If you cancel within 24 hours of your scheduled service for factors other than natural causes outside of your control, you will be charged an "Inconvenience Fee" of $35.00.
Access to Property
Please ensure that we have clear and safe access to your lawn on the day of service. This includes removing any obstacles or hazards, such as parked cars (that could impede our team members from accessing designated service areas), toys, or debris, garden hoses, extension cords, etc. that may interfere with our work. We reserve the right to charge an additional fee if we are unable to access your lawn or complete the agreed-upon services due to obstacles or hazards.
Mowing Services
Mowing Services DO NOT include edging services. Mowing services, despite frequency, are comprised of mowing, trimming vertical features on lawn (i.e., house, shed, play house, dog house, above-ground pool, etc.) and blower cleanup to remove leaves and grass clippings from horizontal hard surfaces (i.e., sidewalk, driveway, walkway, patio, etc.). Service Satisfaction
We strive to provide excellent lawn care maintenance services, and we want you to be completely satisfied with the work we do. If you are not satisfied with our service, please let us know within 24 hours of completion. We will make every effort to address your concerns and make any necessary corrections as soon as our schedule allows.
Refunds
We do not offer refunds for completed services. If you are not satisfied with our services, please contact us within 48 hours of completion, and we will make every effort to address your concerns and make any necessary corrections.
Service Agreement
By accepting the offered services and approving the estimate/job, whether on paper or digital form, you are accepting all of these terms and conditions, as well as, all terms and conditions mentioned on the service order. We can provide you with a copy of the service agreement outlining the scope of work (upon your request), pricing, and other terms and conditions specific to your service. Please review and sign the service contract before we begin any work.
Insurance and Licensing
We are fully insured and licensed to provide lawn care maintenance services in our service area. Please contact us if you need proof of insurance or licensing.
Intellectual Property
All content, materials, and intellectual property on our website and related to our services are the exclusive property of Ace Lawn Masters LLC, DBA Ace Lawn Masters. You may not use, reproduce, or distribute any of our content without our prior written consent.
Indemnification
You agree to indemnify and hold harmless Ace Lawn Masters LLC, its owners, employees, and affiliates from any claims, damages, or losses arising from your use of our services or your breach of these terms and conditions.
Governing Law and Jurisdiction
These terms and conditions shall be governed by and construed in accordance with the laws of the state where we provide our services. Any legal disputes arising from these terms and conditions shall be subject to the jurisdiction of the courts in that state.
Termination of Service (for clients without a contractual agreement)
You may terminate your service with Ace Lawn Masters LLC at any time by providing written notice to us no less than 24 hours away from the scheduled service. We reserve the right to terminate our services to you at any time, without notice, for any reason.
Termination of Service (for clients with a contractual agreement)
Adhere to the terms and conditions of the active contract. Any terms and conditions mentioned on the service agreement or on the service order form will supersede the specific terms and conditions detailed on this page. If no Termination of Service condition was specified, the default time is no less than 7 days from the next scheduled service. This allows us ample time to fill our schedule with another client. Failure to adhere to this would result in a "Swift Termination Fee" of $35.00.
Privacy Policy
We value your privacy and will only use your personal information for the purpose of providing our lawn care maintenance services. We will not share or sell your personal information to third parties without your consent, except as required by law.
Late Payment
If your payment is not received within 7 days of the due date, we reserve the right to charge a "Late Payment Fee" of $35.00 or 10% of the outstanding balance, whichever is greater, and it will accumulate $2.50 per day until the outstanding balance and the late fees are paid in full. After 60 days, we reserve the right to file a Mechanic's Lien with the office of the Clerk of Superior Court on the property that was serviced. If our attempts to communicate with you fail, the 60 days will be circumvented and filing for a Mechanic's Lien will take place immediately. Any and all costs associated with filing the lien, such as, billable hours, transportation costs, and processing fees will be added to your balance. However, if you're experiencing issues paying us, please immediately contact us so we can work with you. We understand life sometimes throws us curveballs. We're your neighbors and we are in a disposition to figure out a viable solution, within a reasonable timeframe. The worst thing you can do is ignore, avoid, or dodge our inquiries for payment collection.
Pricing
Our pricing for lawn care maintenance services is subject to change without notice. We will inform you of any pricing changes before we begin any work, unless unexpected conditions that might require additional time to complete the service, cause damage to our equipment, prevent us from performing the service at all, and that is/are not the fault of Ace Lawn Masters LLC will likely increase the previously discussed pricing for the service.
Additional Services
If you request additional services beyond the agreed-upon services outlined in the service contract, we reserve the right to charge an additional fee for those services.
Projects Requiring Purchase of Materials
If you have requested a service that requires the purchase of materials in order to perform the job, clients will be expected to pay 50% of the project costs a minimum of 72 hours (3 days) prior to the agreed-upon service date. This payment will go toward the purchasing of the necessary project materials.
Waiver
Our failure to enforce any provision of these terms and conditions does not constitute a waiver of that provision.
Entire Agreement
These terms and conditions constitute the entire agreement between you and Ace Lawn Masters LLC and supersede any prior agreements or understandings, whether written or oral, relating to our services.
By using our services, you agree to these terms and conditions. We reserve the right to modify or update these terms and conditions at any time without notice. If you have any questions or concerns, please don't hesitate to contact us.
